Peru revise anti-dumping tax rate on Chinese poplin fabric
The Dumping and Subsidy Review Committee of the Peruvian National Institute for the Protection of Competition and Intellectual Property (INDECOPI) passed Resolution No. 087-2016/CDB-INDECOPI on May 23, 2016, modifying the settings established by Resolution No. 0124-2004/TDC-INDECOPI. The anti-dumping tax rate on poplin fabrics originating in China has been extended by Resolutions 105-2010/CFD-INDECOPI and 021-2016/CDBINDECOPI, and the tax rate has been reduced from US$1.29 per kilogram to US$1.09 per kilogram. The above modifications shall take effect from the date of publication of the resolution in “El Peruvian”. The products involved are gray fabrics that meet the following conditions: plain or dyed, polyester-cotton blended (polyester-to-weight ratio exceeds 50%) used in the production of clothing with a width less than 1.8 meters and a unit weight between 90-200 grams/square meter. Fabrics, the specific tariff numbers are 5407.81.00.00, 5407.82.00.00, 5512.11.00.0, 5512.19.00.00, 5513.11.00.00, 5513.21.00.00, 5514.11.00.00 and 5514.21.00.00.
INDECOPI passed Resolution No. 0124-2004/TDC-INDECOPI in May 2004, imposing anti-dumping duties (27% of the FOB price) on poplin fabrics imported from China for the production of clothing. In May 2010, INDECOPI made Resolution No. 105-2010/CFC-INDECOPI in the sunset review, continuing to implement anti-dumping measures and changing the anti-dumping duty to US$1.29 per kilogram for a period of 5 years until May 31, 2015.
