The U.S. ITC made a partial final ruling on the investigation of specific agricultural packaging materials
On March 9, 2022, the U.S. International Trade Commission (ITC) issued an announcement stating that specific agricultural packaging materials (Wrapping Materials and Methods For Use In Agricultural Applications, investigation code: 337 -TA-1210) made a final ruling on the 337 investigation part: a review of the preliminary ruling made by the administrative judge in this case on December 10, 2021. The content of the preliminary ruling was Zhejiang Yajia Cotton Picker Parts Co., Ltd., Zhejiang Yajia, China. Jiacai Cotton Machine Parts Co., Ltd., Hai’an Xin Fu Yuan of Agricultural Science and Technology Co., Ltd., Jiangsu, China, Zhejiang Yajia Packaging Materials Co., Ltd., Zhejiang, China Jia Packaging Materials Co., Ltd. (added as a named defendant on October 27, 2020) and Southern Marketing Affiliates, Inc. of Jonesboro, Arkansas do not infringe. The details are: (1) The applicant no longer claims that the US registered patent number 6787209 Claims 15, 16, 18, 28, and 45 of -14 items; (4) Zhejiang Yajia Cotton Picker Parts Co., Ltd., Zhejiang, China, Zhejiang Yajia Packaging Materials Co., Ltd., Zhejiang, China Southern Marketing Affiliates, Inc. of Jonesboro, Arkansas does not infringe claims 32, 33, 35-38, and 41-44 of U.S. registered patent number 6787209; (5) the domestic industry technical requirements of U.S. registered patent number 6787209 have been obtained Satisfied; (6) The US registered patent number 6787209 is valid; (7) The economic requirements of the domestic industry have not been met. It is therefore recommended that a general exclusion order be issued and a tax imposed. On December 7, 2021, the listed defendants Yajia and the American SMA requested a review, and on January 4, 2022, the applicant also requested a review. The ITC decided to review the following two parts: (1) In the preliminary ruling, it was determined that Yajia and SMA did not directly or indirectly infringe claims 32, 33, 35-38, and 41-44; (2) In the preliminary ruling, it was held that the domestic industry was not satisfied economic requirements. The investigation period has been extended to May 9, 2022.
On November 30, 2020, the U.S. International Trade Commission (ITC) issued a final ruling: the preliminary ruling made by the administrative judge in this case on November 16, 2020 ( Order No. 11) is not subject to review, that is, China Jiangsu Hai’an Xin Fu Yuan of Agricultural Science and Technology Co., Ltd., China Hai’an Xin Fu Yuan Agricultural Science and Technology Co., Ltd. is the absent defendant.
On October 5, 2020, the U.S. International Trade Commission (ITC) issued a final ruling: the preliminary ruling made by the administrative judge in this case on September 18, 2020 ( Order No. 6) will not be reviewed, that is, based on the consent order, the investigation into Gosun Business Development Co. Ltd., Canada will be terminated.
