Beijing Cotton Field Textile Co., Ltd. sued Japan’s Muji and was awarded 400,000 yuan in compensation
Recently, we learned from the Beijing Court Trial Information Network that the first-instance legal documents for commercial defamation disputes between Beijing Cotton Textile Co., Ltd., Muji (Shanghai) Commercial Co., Ltd., and Ryohin Project Co., Ltd. were released. The trial court was Beijing. Chaoyang District People’s Court of the city.
According to the document, the plaintiff, Cotton Field Company, claimed that the two defendants, including Ryohin Project Co., Ltd., fabricated and disseminated false information that Cotton Field Company had “snap-registered” its “MUJI” trademark, causing the relevant public to misunderstand Cotton Field Company’s “Muji” trademark. Products such as “Yinliangpin” towels and quilts are counterfeit goods, causing losses to the cotton field company, and their behavior constitutes commercial defamation.
The court held that the public statements issued by Ryohin Kekei Co., Ltd. and the two defendants were objectively contrary to the facts, and thus actually derogated the goodwill of Cotton Field Company. The plaintiff’s claim that the defendant constituted commercial defamation has factual and legal basis. The final judgment was that the defendants Ryohin Project Co., Ltd. and MUJI (Shanghai) Commercial Co., Ltd. jointly compensated the plaintiff Beijing Cotton Textile Co., Ltd. for economic losses and infringement suppression expenses totaling 400,000 yuan.
